Statement from NEXOS GE regarding the expulsion of Cameroonian nationals 

Since the 21st of this month, the national police have carried out multiple indiscriminate arrests of Cameroonian nationals for the purpose of repatriation, in compliance with orders issued by the Vice President of the Republic in charge of defence and security.  

Considering that these arrests are in violation of CEMAC community law and the current legal system, the NEXOS GE platform, after deliberation by its board of directors, wishes to make the following statements: 

1. NEXOS GE denounces the illegality of the arrests, which were carried out outside of any judicial process and motivated by the alleged need to control the migration of CEMAC nationals protected by the rule of free movement (additional act 01/13-CEMAC-070).  

2. NEXOS GE strongly condemns the abuse and ill-treatment, acts of xenophobia and torture publicly inflicted on those affected. 

3. NEXOS GE condemns the looting of property and businesses belonging to those affected, as well as the unlawful retention of their property. 

4. NEXOS GE demands the restoration of the right of the victims to judicial protection as regulated by Article 15 of Law 3/2010 of 30 May, regulating the rights of foreigners.  

5. NEXOS GE demands that the defendants be released, as they have not committed any criminal offence, and that they be allowed access to the judge predetermined by law, in order to verify their respective administrative situations on an individual and differentiated basis. They must be granted the right to all other common procedural guarantees, as well as the right to challenge any administrative acts or decisions taken in the course of the proceedings. 

6. NEXOS GE appeals to the competent authorities of the African Union, ECCAS and CEMAC to request the government of Equatorial Guinea to urgently restore the primacy and rule of law, as well as uphold the independence of the judiciary as the guarantor of the effectiveness of the legal system.
